§ 10-292. Definitions.

  • The following words, terms and phrases, when used in this article, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:

    Landfill means any disposal area or tract of land, building, unit or appurtenance, or combination thereof that is used to collect, store, handle, dispose of, bury, cover over, or otherwise accept or retain sludge as defined in this section.

    Sludge. The term "sludge" includes the following:

    (1)

    Bulky wastes, including, but not limited to, appliances, vehicles, furniture, large auto parts, tires, trees, and stumps.

    (2)

    Cell or compacted refuse completely enveloped by cover material.

    (3)

    Garbage, including any putrescible solid and semisolid animal or vegetable wastes resulting from the production, handling, preparation, cooking, serving, or consumption of food or food materials.

    (4)

    Hazardous waste, any material including, but not limited to, explosives, pathological wastes, pesticides, and chemicals, including empty containers previously used for such materials, which when discharged on land, into the air, or into or upon surface waters or groundwaters presents an imminent and substantial danger to public health or welfare or to elements of the human environment, including, but not limited to, aquatic organisms, fish, shellfish, terrestrial life, birds, and other wildlife.

    (5)

    Industrial solid waste, any waste substance or a combination thereof resulting from the operation of or from any process of industry, manufacturing, trade or business, or from the development of any agricultural or natural resources.

    (6)

    Inert sold wastes, including, but not limited to, glass, crockery, brick, plastics, rubber, or other materials which are shown through analytical testing to have minimum potential for environmental degradation and leachate production.

    (7)

    Leachate is any fluid that has percolated through solid waste and which contains contaminants consisting of dissolved or suspended materials, chemicals, and microbial waste products from the solid waste.

    (8)

    Other wastes, including garbage, refuse, lime cinders, offal, oil, tar, dye-stuffs, acids, chemicals, and all discarded materials other than sewage or industrial wastes.

    (9)

    Refuse, including any putrescible or nonputrescible solid waste, except human excreta, but including garbage, rubbish, ashes, street cleaning, dead animals, offal, and solid agricultural, commercial, industrial, hazardous and institutional wastes, and construction wastes resulting from the operation of a contractor.

    (10)

    Rubbish or any nonputrescible solid waste, excluding ashes, such as cardboard, paper, plastic, metal or glass food containers, rags, waste metal, excelsior, rubber, leather, crockery, and other similar materials.

    (11)

    Sewage or any water-carried human or animal wastes from septic tanks, water closets, residences, building, industrial and municipal establishments, or other places, together with such groundwater infiltration, subsurface water, mixtures of industrial wastes, or other wastes as may be present.

    (12)

    Sludge or any semiliquid sediment resulting from industrial, municipal establishments, or other places, together with such groundwater infiltration, subsurface water, mixtures of industrial wastes, or other wastes as may be present.

    (13)

    Solid waste or any garbage, refuse, rubbish, special solid waste, other waste, or any combination thereof with insufficient liquid content to be free flowing.

    (14)

    Solid waste disposal facility, including any solid waste disposal site, system or process, the operation thereof including, but not limited to personnel, equipment and buildings.

    (15)

    Special solid waste or any hazardous wastes, radioactive wastes, agricultural wastes, industrial wastes, or sludges and sewage residues.
