    (a)

    Purpose. This section is enacted to provide authority to assess and levy charges and collect fees incurred by the constable or constables and/or the fire department, rendered to protect individuals, entities or their property, who are not Monroe Charter Township residents. It is also intended to provide notification of said fees by resolution.

    This section intends to charge for the following incidents:

    (1)

    Accidents involving aircraft, rail trains, trucks and/or other vehicles for the transportation of goods or people.

    (2)

    Vehicle fires (both accidental and arson).

    (3)

    Marine/boat rescues.

    (4)

    Non-injury vehicle accidents.

    (5)

    PDA incidents (property damage accidents).

    (6)

    PI accidents (personal injury).

    (7)

    Recovery of stolen vehicles and properties.

    (8)

    Safety investigations.

    (9)

    Traffic obstructions caused by vehicles where constables and/or the fire department provide traffic control.

    (10)

    Securing, control and monitoring of any hazardous condition created by any disruption or damage of utility distribution property and equipment.

    (11)

    Extinguishment, control and monitoring of any "out of control" and/or unauthorized fire.

    (12)

    Any other request for service within the township by any other agency.

    (b)

    Establishment of fees. The township determines that any and all persons, firms or corporations receiving emergency constable and/or emergency or non-emergency fire department services for the protection of their person or property, who are not residents of the township at the time the services are provided, shall remit an amount, as determined by subsequent resolution or resultions of the board, for each incident requiring services. The funds received are to be used to defray the costs of operating and housing the equipment, labor and supplies for such services by the township constables and fire department.

    (c)

    Fees. The fees, for the services provided by the township, shall be established by resolution of the township board and may be modified, from time-to-time, by resolution of the board. Upon passage of a schedule of fees, it shall be available at the office of the clerk for inspection by the public during regular published office hours.

    (d)

    Billing. An expense incurred for an emergency response shall be charged as a fee imposed upon the recipient of the service and is collectable by the township in the same manner as an obligation provided by contract, either express or implied.

    (e)

    Multiple protection or aid. If a particular service,rendered by the constable and/or fire department, directly benefits more than one non-resident person or entity, or their property, the owner or each property so benefited, and each person or entity so benefited, where property protection is not involved, shall be liable for the payment of the full charged fee for such service outlined above.

    (f)

    Collection of expenses. The township shall, within 30 days after receiving itemized costs incurred for emergency responses, submit a statement of charges for the same by first class mail or by personal service to the person liable for these expenses, as set forth herein. The statement, provided by the clerk, shall require payment within 30 days.

    The township may proceed by suit, in a court of competent jurisdiction, to collect any monies remaining unpaid after they are due and shall have any and all remedies provided by law to collect the fees herein established.
