Article V. TRUCK ROUTE ORDINANCE |
§ 28-133. Truck routes.
(a)
Travel into and out of the township. Restricted trucks that do not have a scheduled pickup, delivery, or service within the township, are required to enter and exit the township on truck routes only.
(b)
Travel within the township. Restricted trucks traveling within the township are required to travel on truck routes only, except as follows:
(1)
Implements of husbandry used in the transportation of produce from the field or farmstead to the point of sale or incidentally moved upon a township road; provided that the most direct route to a truck route is used;
(2)
Road repair, construction or maintenance vehicles while involved in the repair, construction or maintenance of road within the township;
(3)
In compliance with any officially-recognized detour;
(4)
In compliance with any Haul and Maintenance Agreement or Special Haul Agreement applicable to the restricted truck, as specifically set forth in section 28-134;
(5)
Delivery and service call restricted trucks while making a delivery, pick-up or service call; provided that:
a.
The most direct route to a truck route is used;
b.
The restricted truck complies with seasonal, posted or special weight restrictions;
c.
The restricted truck is complying with any Haul and Maintenance Agreement, or a Special Haul Route Agreement, if applicable; and
d.
The restricted truck is not part of road usage that the county highway engineer has determined is "abnormal use."
(6)
Traveling to a personal residence within the township or to a storage at a commercial or industrial location for the purpose of storing or parking the restricted truck, provided that
a.
The most direct route to and from truck route is used;
b.
The storage of a restricted truck at a personal residence is otherwise permitted by the Code; and
c.
The restricted truck is not loaded.
(b)
Obligations. It shall be the duty of any owner or responsible person in charge or control of any restricted truck on a township road that is not a designated truck route to stop upon the request of a police officer and answer any questions such officer may have regarding the weight of the restricted truck, its destination, and its point of origin; and such person shall also present the log book, weight slips, delivery slips and other written evidence of destination or point of origin, for the officer's examination.
