§ 10-114. Enforcement.

  • (a)

    The township board is hereby authorized and directed to enforce all the provisions of this article. It shall appoint an enforcement officer with the duty of enforcing this article. This officer shall be directly under the control of the township board and shall, for the purpose of this article, have the powers of a police officer and may delegate this power to his assistant or assistants. The enforcement officer shall monthly verify the sworn statements of the operators or owners as to the amount of soil, sand, and rock removed or excavated. He shall likewise note the effect of these operations on surrounding lands, lands being excavated, occupants of adjoining lands, and roads used in removal. He shall report on these matters monthly to the township board.

    (b)

    The township supervisor or enforcement officer are hereby authorized to take such legal action in the courts, in the name of the township, as he determines is necessary to enforce the terms of this article.
