§ 10-291. Purpose.

  • The hauling, storage, dumping, utilization, disposal, or the filling of land with "sludge," as defined in subsection 10-292, is an activity which, if conducted on certain lands or in certain ways, will result in the emission of noise, dirt, dust, and odors, and such operations affect permanent changes in the topographical, geological, and hydrological characteristics of land. Further, because of the changes, such operations create dangers and hazards by virtue of shifting earth, standing water, filtration into the underground water system, either natural or fabricated, impairing and destroying of natural resources, and other like considerations. Reasonable control of these operations, including licensing and regulation of business establishments which haul, utilize, or dispose of sludge, is required to protect the township's natural resources and the public health, safety, and general welfare. The standards and regulations contained in this article are the minimum regulations capable of assuring the protection of the natural resources of the township and adjacent areas and the public health, safety, and general welfare. The administration of such standards are provided for and penalties are set forth in this article.
