§ 14-30. Dike inspectors.

  • (a)

    There is hereby created the position of township dike inspectors, whose duties it shall be to annually, or as otherwise required, inspect all existing dikes, seawalls, and other protective barriers erected to prevent the flooding of property and to report such conditions as they shall find to the enforcement officer. The enforcement officer shall have full and complete authority to sign complaints for violations. Dike inspectors, being representatives of the enforcement officer, shall accompany the enforcement officer in making inspections of all dike construction (alterations and new). If the inspector identifies a condition which is not consistent with the provisions of this article, he shall notify the enforcement officer, who shall immediately issue a noncompliance stop work order until the condition is corrected. The property owner may appeal the noncompliance stop work order to the board of appeals. The dike inspector shall receive a stipend set by the township board for regular inspections of existing dikes. Before issuing a final dike ordinance compliance certificate, the elevation must be verified by the township to ensure compliance of the requirements of the dike ordinance compliance permit for the dike in question. There may be appointed two dike inspectors and they shall be appointed by the township board, and such inspectors shall serve at the pleasure of the township board.

    Dike inspectors shall be responsible for updating the dike report with all new pertinent information as it is received, such as height, construction, type of dike, etc. In the event that the inspector identifies a condition which requires maintenance, he shall report it to the enforcement officer, who after verifying these conditions shall within three business days, notify the property owner, in writing, with a copy of the notice to be given to the building department to be filed with the property card. Within 15 consecutive days after such notification, the property owner shall advise the enforcement officer, in writing, of the appropriate action proposed to be taken and shall receive written approval from the enforcement officer to proceed with the repairs. If, in the opinion of the enforcement officer, proper remedial repairs were made in an expeditious manner, he shall record that fact on the township copy of the original notification and notify the property owner, and the dike inspector making the complaint of that fact to finalize compliance. Should the property owner disagree with the enforcement officer's recommendation, the owner may apply to the dike review commission as provided in this article for a hearing on the application. If the property owner fails to take any action to make repairs, he shall be subject to violation of this article and its penalties.
